One of the charges levied against Kevin Edson, the man who allegedly left an unattended backpack by the Boston Marathon finish line exactly one-year after the tragic bombings, has been dropped.

According to the Associated Press, Edson will no longer face a charge of making a false bomb threat. He still faces charges of possession or use of a hoax device, disturbing the peace, disorderly conduct and disturbing a public assembly.

The AP notes further that the Suffolk County DA’s office dropped the charge because, despite how unnerving Edson’s actions were, he did not communicate a clear threat to public safety. The backpack, however, contained a rice cooker – eerily reminiscent of the dual pressure cookers that combusted on Boylston Street killing 3 and injuring 264.

Back in May, it was determined after a a psychological evaluation that Edson was fully and mentally competent to stand trial despite the fact that he suffers from bipolar disorder and, according to a statement released by his family after Edson’s arrest, multiple other mental health issues.

Possession or use of a hoax device is the most consequential charge brought against Edson. Per Massachusetts General Law, he faces up to 10 years in prison and a $250,000 fine. He plead not guilty to all charges.
